GENERAL CONDITIONS OF SALE
1. OBJECT
These general conditions of sale (hereinafter, the “Conditions”) govern the contractual relations between PALOMA WOOL, S.L. (hereinafter, “PALOMA WOOL” or the “Vendor”) and any natural person of legal age or legal entity (hereinafter, the “Customer” or “You”) making a purchase order for products presented on the official online store accessible at the website woolwomens.com (hereinafter, the “Website”).
The acquisition of any product through the Website implies the Customer’s unreserved acceptance of these Conditions. The Customer declares to have read and accepted these Conditions without reservation before placing an order.
PALOMA WOOL reserves the right to modify these Conditions at any time. The applicable conditions are those in force on the Website on the date the order is placed.
2. PRODUCTS
The products offered for sale are those featured on the Website, within the limits of available stock. PALOMA WOOL uses its best efforts to ensure that the visual representations of products (photographs, graphics, etc.) are as accurate as possible. However, variations (for example, in color) may occur due to the technical characteristics of computer screens and browsers; PALOMA WOOL cannot be held responsible for such variations.
Product descriptions, including information on materials, care, and features, are provided for informational purposes. While PALOMA WOOL strives for accuracy, it shall not be held liable for any minor errors or omissions in these descriptions.
3. ORDERS
To place an order, the Customer must select the desired products and add them to their shopping cart, then follow the steps of the ordering process, providing the required information.
The Customer must ensure that all information provided during the ordering process (particularly delivery address) is complete and accurate. PALOMA WOOL shall not be held responsible for delivery delays or errors resulting from incorrect information provided by the Customer.
An order is only considered final once the Customer has confirmed it after verifying the details (products, prices, quantities) and the Customer has received a confirmation email from PALOMA WOOL acknowledging receipt of the order. This email, which does not constitute acceptance of the order, will summarize the order details.
PALOMA WOOL reserves the right to refuse any order for legitimate reasons, particularly in the event of existing disputes with a Customer, orders placed in bad faith, or abnormal orders.
4. PRICE AND PAYMENT
The prices of products are indicated on the Website. They are expressed in the currency shown on the Website and include applicable taxes at the time of the order, excluding shipping costs which are added to the total price before payment confirmation.
PALOMA WOOL reserves the right to modify its prices at any time but the products will be invoiced based on the prices in force at the time the order is registered.
Payment for orders is due immediately upon confirmation of the order. The Customer can make payment using the methods offered on the Website (credit/debit card, PayPal, etc.). The payment transaction is secured by encryption. The order will only be validated upon successful receipt of payment by PALOMA WOOL.
5. DELIVERY
Delivery means the transfer of physical possession of the product to the Customer. Products are delivered to the address indicated by the Customer during the ordering process.
PALOMA WOOL will make every effort to deliver the products within the timeframes indicated on the Website. However, these timeframes are provided for information purposes only and are not strict deadlines. Delays in delivery shall not entitle the Customer to cancel the order or claim damages, except in cases of delay so severe that it constitutes a fundamental breach of contract.
Upon delivery, the Customer must check the condition of the product(s). In the event of visible damage, missing items, or any other anomaly, the Customer must indicate precise reservations on the delivery note and immediately inform the carrier and PALOMA WOOL.
Risk of loss or damage to the products passes to the Customer upon delivery at the designated address.
6. RIGHT OF WITHDRAWAL
In accordance with applicable regulations, the Customer has a period of fourteen (14) calendar days from the receipt of the products to exercise their right of withdrawal, without having to provide any reason.
To exercise the right of withdrawal, the Customer must notify PALOMA WOOL of their decision to withdraw by means of an unambiguous statement (for example, a letter sent by post or email using the contact details provided in the return section of the Website, though a model withdrawal form is also available). The Customer may also use the model withdrawal form provided on the Website.
The products must be returned to PALOMA WOOL without undue delay and in any event no later than fourteen (14) days after the day on which the Customer communicated their decision to withdraw. The direct cost of returning the goods shall be borne by the Customer.
The returned products must be in perfect condition: unworn, unwashed, with original tags attached, and in their original packaging. PALOMA WOOL will refund all payments received from the Customer, including standard delivery costs (excluding any additional costs for a chosen delivery method other than the least expensive standard option offered), without undue delay and in any event within fourteen (14) days from the day the withdrawal is exercised. PALOMA WOOL may withhold reimbursement until receipt of the products or until the Customer has provided proof of shipment, whichever is earlier.
Refunds will be made using the same payment method used for the initial transaction, unless the Customer expressly agrees otherwise.
Please note that the right of withdrawal does not apply to goods made to order or clearly personalized.
7. WARRANTY
All products sold on the Website benefit from the legal guarantee of conformity and the guarantee against hidden defects, in accordance with applicable legislation.
In the event of non-conformity, the Customer has the right to have the product repaired or replaced, subject to the conditions of cost and feasibility. If repair or replacement is impossible, disproportionate, or not carried out within a reasonable time, the Customer may be refunded or keep the product at a reduced price.
To exercise these rights, the Customer must contact PALOMA WOOL, providing proof of purchase and a description of the defect or non-conformity.
8. INTELLECTUAL PROPERTY
All elements of the Website (texts, graphics, logos, images, audio clips, software, etc.) are the exclusive intellectual property of PALOMA WOOL or its partners. Any reproduction, representation, or distribution, in whole or in part, of the content of the Website on any medium or by any process whatsoever is strictly prohibited without prior authorization.
9. PERSONAL DATA
The personal data collected during the ordering process is necessary for the processing and management of orders, as well as for commercial prospecting purposes (if the Customer has consented). This data is processed in accordance with the Privacy Policy available on the Website.
In accordance with applicable regulations, the Customer has a right of access, rectification, erasure, and opposition regarding their personal data.
10. FORCE MAJEURE
PALOMA WOOL shall not be held liable for any failure or delay in the performance of its obligations hereunder if such failure or delay is due to a cause beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, shortages of transportation facilities, fuel, energy, labor, or materials, or any other event beyond the reasonable control of PALOMA WOOL.
11. ENTIRE AGREEMENT
These Conditions, together with the order summary and the Website’s privacy policy, constitute the entire agreement between the Customer and PALOMA WOOL regarding the sale of the products. They prevail over any other contrary document or communication.
12. NULLITY
If any provision of these Conditions is held to be invalid or unenforceable by a court or other competent authority, the remaining provisions shall remain in full force and effect.
13. APPLICABLE LAW AND JURISDICTION
These Conditions are governed by and construed in accordance with applicable law.
Any dispute that may arise from the interpretation or execution of these Conditions shall be subject to the exclusive jurisdiction of the courts, without prejudice to the applicable legal provisions regarding consumer protection which may allow the Customer to bring proceedings in their country of residence.
